Microsoft Gulf FZ LLC ("Microsoft") is the Event organiser and intends hosting Microsoft Tech·Ed Middle East 2010 ("the Event"), which shall be
held from March 1st to March 3rd, 2010 and which the attendee registering for the Event ("the Attendee") wishes to attend.
By registering for Tech·Ed Middle East 2010 you agree unconditionally to the Terms and Conditions set forth herewith. These terms and conditions,
together with official Event communications by Microsoft, shall govern and apply to all participation and activity arising out of and relating to the
Event. Please take a moment to review these terms and conditions, which will govern all aspects of your relationship with the Event and Event-related
agents. These rules cannot be modified or superseded except by Microsoft, in its reasonable discretion, in a written revision to these terms and conditions.
A copy of the terms and conditions for this Event can be obtained, free of charge, by any person requesting it from
registration@teched.ae.
General
- Registration for Tech·Ed Middle East 2010 is not considered confirmed until payment has been received in full. No admittance to the conference
will be granted without payment being received in full.
- All payments must be made in AED or USD and received within 5 days of registration being submitted and in any case no later than Sunday, February 28,
2010.
- Non-payment within the prescribed time will result in immediate cancellation. If payment of the Registration Fee is not received, then Microsoft shall
be entitled to stop the Attendee from accessing any information relating to the Event, cancel the Attendee’s booking and recover from the Attendee the
cancellation charges specified in the relevant section below.
- Lost Attendee badges will incur a replacement fee.
- You will be required to produce relevant Government issued photo identification (passport, driving license or national ID card) when collecting badges
onsite; as well as when obtaining replacement Attendee badges.
- By accepting these Terms & Conditions, you authorize the Event team to contact you or your designated representatives regarding the status of your registration
and / or relevant Event information.
- The person who registers on behalf of an Attendee or Attendees warrants that they are duly authorised to make such registration and agrees that Microsoft
may retain, process and export their personal information within Microsoft Corporation and/or any of its subsidiaries.
Cancellations
- Cancellations received by 23:59 GST on Sunday 14 February 2010 will be charged 25% of the relevant Registration Fee. Cancellations after this date, as
well as ‘no shows’, will be liable for the FULL Registration Fee.
- Please notify the Support Centre of any cancellations in writing by one of the following methods:
- Cancellations shall only be effective once confirmed by Microsoft or its registration vendor.
- Should Microsoft cancel Tech·Ed Middle East 2010, paid registered Attendees will be refunded their Registration Fee only. No other costs will be
refunded.
- All and any travel arrangements, e.g. flights, car hire, etc, except for the transfers offered by Microsoft on the Event website are for the account and
responsibility of each individual Attendee.
Substitutions
- Only Attendees who are confirmed and paid can be substituted.
- The original Attendee should not cancel the registration. Substitutions between Attendees using the same payment may be made by:
- logging in to
My Tech·Ed
- contacting the Support Centre
- Substitutions can be made at any time leading up to the Event, including at onsite registration.
- Substitutions shall only be effective once confirmed by Microsoft.
- These terms and conditions shall be binding on any substitute.
Group Registrations
- You will be offered one (1) free delegate for every ten (10) delegates registered from your company in your group during registration only.
This offer does not apply if members are added to your group at a later stage.
You will forfeit this promotion if and when:
- your group is cancelled.
- Attendees within your group are cancelled.
- Where a cancellation is made, 25% of the relevant Registration Fee will be charged for each paid member of the group that cancels their registration.
- In the event that a Group Registration discount has been awarded to a company and that one or more registrations are subsequently cancelled, the overall
Registration Fee may be taken into a lower discount bracket. In such cases the refunded Registration Fee will be paid net of the group's revised discount
plus cancellation fee.
- Should the cancellation of a Group Registration member be made after 23:59 GST (Gulf Standard Time) on Sunday, 14 February 2010, no refund will be payable.
Super Early Bird and Early Bird Offers
- The “Super Early Bird Special” and "Early Bird Special" are discounted prices on Registration Fees , and are subject to the following criteria being met:
- Registration fully submitted at any time before 23.59 GST on
Sunday, December 27, 2009
for Super Early Bird or any time between then and 23.59 GST on
Sunday, January 31, 2010
for Early Bird;
- Payment received within 5 days of date of registration in order to qualify for the Super Early Bird Special or the Early Bird Special;
- For group registrations: group members included in the registration are given ten days to complete their personal details. So, any group registration
completed before the end of the Super Early Bird Special and Early Bird Special will be awarded the discounted rate. For this reason, Attendees are urged
to complete their registrations well in advance of the last days of the Super Early Bird and Early Bird Specials to avoid missing the deadline and thus
not qualifying for the discounted rate.
Intellectual property
- Materials provided by Microsoft remain the intellectual property of Microsoft Corporation and its partners, who assert their right to worldwide copyright
unless specifically agreed otherwise in writing.
- The recording by any means of any conference sessions at Tech·Ed Middle East 2010 by Attendees and/or third parties is strictly prohibited.
- You consent to Microsoft (or its designees who have been specifically employed by Microsoft to make on-site recordings) recording you by any means including,
without limitation, electronic recording, film, videotape, audio tape and photography (the “Recordings”) without compensation of any kind to you. You
agree that Microsoft shall be the copyright owner of the Recordings. You understand that Microsoft is not obligated to use the Recordings.
- To the best of your knowledge, your acts and statements contained in the Recordings will not violate any right of any other person or company.
- You release Microsoft from any claims and causes of action you may have now or in the future based upon defamation, invasion of right of privacy, publicity
or personality, copyright or trademark infringement and unfair competition in connection with the Recordings and Microsoft’s use of the Recordings and
you agree not to institute any legal action based on any of the grounds specific in this section.
- All the rights granted to Microsoft by you hereunder are irrevocable and perpetual, and you waive all rights to any equitable relief in connection with
herewith.
Force majeure
- In the event that Microsoft is prevented from carrying out its obligations as a result of any cause beyond its control, such as but not limited to acts
of God, war, acts of terrorism, airline flight cancellations, strikes, lock-outs, flood, commercially unfeasible, pandemic influenza attack, fear of contacting
influenza, and failure of third parties to deliver goods or services, Microsoft shall be relieved of its obligations and liabilities for as long as fulfilment
is prevented.
Data protection
- Microsoft does not sell, trade or rent your personal information to others.
- By registering for Tech·Ed Middle East 2010 you give Microsoft (and its vendors and service suppliers) permission to contact you regarding your
attendance at the Event.
- The contact information supplied during registration will only be used to send you relevant Event related information.
- Information you provide during registration will be used by Microsoft for the purposes of assessing the technology requirements and areas of interest
of attending individuals and companies.
- Microsoft’s Privacy Statement is attached to these Terms and Conditions. By agreeing
to these Terms and Conditions you also give your consent to the way we may handle your personal information under that Privacy Statement.
Disclaimer and Limitation of Liability
- Participation in this Event entails full acceptance of these terms and conditions and of Microsoft's decision as to any dispute concerning the interpretation
of or the application of these terms and condition, and more generally, as to any difficulty not provided for herein concerning the existence, conduct
or achievement of the Event.
- The Attendee shall indemnify and hold Microsoft harmless from and against any and all claims, suits, actions, damages or liabilities that arise in connection
with the Attendee's participation in the Event.
- Whatever the legal basis of a claim and notwithstanding anything to the contrary in these terms and conditions, Microsoft's liability to the Attendee
under these terms and conditions and howsoever arising will be limited, to the maximum extent permitted by applicable law, to direct damages up to the
Registration Fee.
- Participation in the Event implies knowledge and acceptance of the nature and limits of the internet, in particular in regard to technical performance,
consultation response times, the querying and transferral of data, the risk of disconnection, and more generally those risks inherent to any internet
connection and transferral of data, including shortfalls in protecting against possible data abuse, and the risks of contamination from network viruses.
- As a result, Microsoft shall not, in any event, be held liable for the following (this list is not restrictive):
- the transferral and/or receipt of any data and/or information on the Internet;
- any Internet network malfunction preventing the smooth running or functioning of the Event;
- the failure of any receipt equipment or communication lines;
- the loss of postal entries or electronic mail entries and, more generally, any loss of data;
- routing problems;
- the functioning of any software;
- the consequences of any viruses, software bug, error, or technical failure;
- any damage caused to a Attendee's computer;
- any technical, material or software failure of any nature, preventing or limiting participation in the event or damaging a Attendee's system.
- Microsoft shall not be held liable for any direct or indirect damage resulting from a disconnection, malfunction of any type, for any reason whatsoever,
or for any direct or indirect damage resulting from, in any form whatsoever, connecting to their messaging system.
- It is the responsibility of each Attendee to take all of the appropriate measures required to protect his or her own data and/or software stored on his
or her computer equipment/laptop/device against attack whilst at Tech·Ed Middle East 2010. Each person who connects via the Tech·Ed network
to his or her personal device/s during the Event does so under his or her sole responsibility.
- Microsoft shall not be held liable for damages arising out of or in any way associated with the Event.
- Microsoft waives any liability for any errors and/or omissions by the Attendees in following the application for participation procedure.
- Any fraudulent act will disqualify the Attendee. In the event of a failure on the part of an Attendee, Microsoft reserves the option to exclude, in accordance
with the law, the latter from the Event, with this individual having no rights to any claims of any nature.
Governing law
These Terms and Conditions are governed by the laws of Dubai, United Arab Emirates and are subject to the exclusive jurisdiction of the courts of Dubai,
United Arab Emirates.
- The Tech·Ed Middle East 2010 conference is hosted by Microsoft who reserves the right, in their sole discretion, to limit or deny access to the
conference to any entity or individual.
- Microsoft’s receipt of an application and/or payment does not constitute acceptance. Application and payments that are not accepted will be returned.
You must accept these terms and conditions to complete your registration to attend Tech·Ed Middle East 2010.
